Terms of service
Last updated: 16 October 2026
These Terms of Use (“Terms”) govern the ComiGami iOS application, the website comigami.com, and related support services provided by Chebellagiornata Srls (together, the “Service”). ComiGami was previously released under names including “Comic AI: Comics Generator” and “Comics AI: Comix Generator”; these Terms also apply to an updated version distributed through the same App Store listing.
Please read these Terms before using the Service or making a purchase. Our Privacy Policy explains how personal information is handled. Acceptance of these Terms is not consent to model training, promotional use of your photographs, unrelated reuse of your creative content, or optional analytics or advertising.
1. Service provider and agreement
The provider is Chebellagiornata Srls, Via San Crispino 106, 35129 Padova, Italy, VAT number IT04962980282. Contact us at info@chebellagiornata.com.
You agree to these Terms when you expressly accept them in the App, request a generation after the Terms have been presented, or purchase a product governed by them. The information displayed in the App Store purchase sheet before confirmation, including the product, price, currency, billing period and any offer, forms part of the relevant transaction. Mandatory law prevails over any inconsistent provision.
2. Eligibility and minimum age
You must be at least 16 years old to use ComiGami. If you are 16 or 17 and cannot independently enter the relevant contract or make a purchase under the law applicable to you, a parent or legal guardian must provide the required authorization. Apple’s account and purchase requirements also apply.
The App Store content rating does not establish your age, capacity to contract, permission to use another person’s photograph, or ability to consent to every processing activity. ComiGami does not currently offer a verified parental-consent procedure for users below its minimum access age.
You must use the Service lawfully and provide accurate information when support or purchase verification requires it. Availability depends on supported devices, operating systems, countries and App Store products.
3. What ComiGami does
ComiGami lets you save photo-based characters, optional environments and other creative materials; choose an art style; describe a scene; associate dialogue with characters; and request an AI-generated illustrated comic page with multiple panels. Completed pages can be saved in local History, viewed, zoomed, exported to Photos and shared.
One “creation” means one complete comic page generated as a single result, not one individual panel. The number, layout and content of panels are determined by the story, style, model and technical constraints and are not guaranteed to be identical from one creation to another.
The Service uses external AI and may produce unexpected layouts, incorrect text, visual artifacts, inconsistent details or a likeness that is only approximate. Results are creative outputs, not factual records or identity verification. You must review a result before publishing, relying on it or using it commercially.
New generations require an internet connection, a supported device, available credits or an applicable legacy entitlement, and access to the relevant Apple, RevenueCat, Firebase, Railway and OpenAI services. Network and device charges are your responsibility.
4. Anonymous identity, devices and continuity
ComiGami normally creates an anonymous App identity rather than requiring an email-and-password account. That identity, together with Apple purchase information and an internal commercial identifier, is used to protect requests, determine free-creation eligibility, maintain credits, recognize subscriptions and recover eligible purchase information.
You are responsible for protecting access to your iPhone and Apple Account. Do not sell, rent, transfer or share access in a way that enables unauthorized generations or purchases.
Reinstalling the App, changing device or creating a new anonymous Firebase identifier does not create a new free benefit or a second credit balance. Recovery may require the same Apple Account used for the purchase, the Restore Purchases control and, in some cases, support-assisted reconciliation.
Your locally saved characters, environments, drafts and History are not a complete cloud-synchronized library. A subscription or purchase restore does not necessarily restore local creative content from a deleted or lost device. Export important comics and maintain an appropriate device backup.
5. One-time free comic creation
An eligible user may receive 10 promotional credits once, enough for one complete comic-page creation, without purchasing a subscription. This is a one-time product preview, not an automatically renewing free trial.
The free creation is intended for a person who has never previously subscribed to ComiGami or a legacy version and has not already used the free creation. Former subscribers are not eligible merely because their subscription has ended. The server’s verified records determine eligibility.
The App may reserve the free credits when a job is accepted. They are consumed when the result has been successfully generated, stored and made recoverable. A confirmed technical failure can release the reservation. When the provider outcome is uncertain, the reservation may remain pending while we reconcile the same job rather than authorize a duplicate paid generation.
Deleting the result, reinstalling the App, changing a device or anonymous identifier, clearing local data, or changing the story date does not restore the one-time free credits. Recovering or downloading the same completed result does not consume another credit.
6. Premium Weekly and subscription credits
Premium Weekly
Where offered, Premium Weekly is an auto-renewing weekly subscription purchased through Apple’s App Store. The purchase screen displays the current price, currency, taxes, billing period and included features before you confirm.
Each verified weekly Premium period includes 100 subscription credits. A complete comic-page creation uses 10 credits, so the weekly allocation is enough for up to 10 creations when each accepted job uses the standard 10-credit price.
Subscription credits are a recurring allowance included with Premium, not separately purchased consumable credits. The weekly allowance does not roll over: unused subscription credits are not added to the next weekly allocation. A verified renewal supplies the next period’s allocation without creating duplicates. Cancellation stops future renewals and future weekly allocations after the current paid period ends.
Opening, recovering, downloading, viewing, exporting or sharing an already generated comic does not use additional creation credits. Editing a local draft or material does not use credits. A materially different new generation does.
No automatic trial
The one-time free comic is separate from Premium. Premium does not include an App Store introductory trial unless Apple’s purchase sheet expressly states that a trial applies to you. Do not rely on wording outside the purchase sheet to determine trial eligibility.
Legacy subscriptions
Older App Store products may have been sold with different billing periods or an “Unlimited” generation entitlement. Those are separate legacy products. The new Premium Weekly credit plan does not automatically replace or reduce an active legacy entitlement. The rights associated with an existing legacy purchase remain governed by the product information presented when purchased, any lawful later notice and the applicable App Store rules. We may need to distinguish legacy products from the new Premium product by their verified Product ID.
7. Extra credit packs
Where made available in the App, you may purchase additional consumable credit packs through Apple. Packs may include 100, 200 or 1,000 credits; the exact quantity, price, currency and eligibility conditions are shown before purchase. Some packs may be presented to Premium users, but purchased credits that have already been validly credited do not expire merely because Premium later ends.
Purchased credits are kept in a server-side balance separate from the non-rollover weekly allowance. Credits purchased through in-app purchase do not expire. They are not money, a deposit, a gift card or a stored-value payment instrument; they cannot be redeemed for cash, transferred or resold, except where mandatory law requires a remedy.
The same valid transaction must be credited only once, even if Apple or RevenueCat sends duplicate or delayed events. If Apple refunds, revokes or cancels a credit-pack purchase, we may reverse the corresponding unused credits. If those credits have already been spent, we may adjust the remaining balance or temporarily restrict further paid-credit use while the transaction is reconciled, without limiting any mandatory consumer right.
Consumable purchases may not be restored by Apple in the same way as a subscription. ComiGami uses its own verified purchase and credit ledger to recover an eligible balance through the same Apple Account where technically and legally possible. Keep your purchase receipt and contact support if the displayed balance is incorrect.
8. How credits and generation jobs work
Our backend is the authoritative record of free eligibility, subscription allocations, purchased-credit balances, reservations and consumption. The App displays the information received from the server. Contact us if you believe the balance is wrong.
When you submit a creation, ComiGami may reserve 10 credits before beginning external AI processing. A successful result consumes the reservation once. A retry that resumes the same job, status check, download or recovery does not create a second charge. A confirmed failure releases the reservation according to the applicable rules; an uncertain external outcome may remain pending until reconciled.
Different credit categories may be shown separately. Non-expiring purchased credits will not be made to expire solely because a subscription allocation resets or Premium ends. The App may apply available credit categories in the order shown or described in the current purchase and balance interface.
We may apply proportionate technical limits on simultaneous jobs, closely spaced requests, automated use and aggregate service spend. These safeguards are separate from the disclosed credit price and are not an undisclosed ordinary quota. A high number of legitimate requests is not, by itself, conclusive proof of abuse.
9. Apple purchases, renewal, cancellation, Restore and refunds
Payment and automatic renewal
Payment is charged to your Apple Account under Apple’s purchase rules. Premium renews for successive weekly periods unless cancelled. Apple may charge renewal shortly before the next period begins. Cancel before renewal to avoid the next charge.
Apple administers billing, taxes, renewal and payment-method processing. Price changes are communicated through the applicable App Store process, with consent where required. A new price does not retroactively alter a completed billing period.
Managing and cancelling
Use the subscription-management link in the App or open iOS Settings → your name → Subscriptions → ComiGami. You can also follow Apple’s cancellation instructions. Cancellation normally stops the next renewal while paid access continues until the end of the current paid period, subject to refunds or other adjustments.
Deleting the App, deleting local data, requesting deletion of ComiGami server data or stopping use does not automatically cancel an Apple subscription. You must manage renewal separately through Apple.
Restore and reconciliation
Use Restore Purchases while signed into the Apple Account associated with the purchase if an active subscription or legacy entitlement is not reflected. Restore does not create a second purchase, a second free creation or a duplicate credit allocation. Purchased consumable credits may require server-side reconciliation rather than Apple’s standard subscription restore.
Refunds
App Store refund requests are generally processed by Apple through reportaproblem.apple.com. Cancellation alone does not automatically refund a prior charge. Nothing in these Terms excludes a refund, price reduction, correction or other remedy required by law. You may contact us for assistance with the technical status of an entitlement or credit balance.
10. Your photographs, prompts and other input
You retain the rights you hold in photographs, names, descriptions, stories, dialogue and other material you submit (“Input”). You must have all rights, permissions and lawful bases necessary to upload and process the Input and to use the requested result.
In particular, before uploading another person’s image you must have that person’s express permission and all necessary rights. For a minor, you must be the parent or legal guardian or otherwise have lawful authority, and the use must be age-appropriate and in the minor’s best interests. Permission to take a photograph does not automatically include permission to transform or publish it.
You grant us a limited, non-exclusive licence to host, copy, resize, transmit, process and display the Input only as needed to provide, secure, recover and support the Service, including transmission to the providers identified in the Privacy Policy. This licence does not transfer ownership to us and does not authorize us to publish your Input, use it in advertising or train a general-purpose model without a separate lawful basis and any required consent.
You should not upload medical records, financial credentials, government identifiers, confidential business information or unnecessary sensitive information. Do not use material whose disclosure would violate privacy, confidentiality, copyright, trademark, publicity or other rights.
11. Generated output and intellectual property
As between you and Chebellagiornata Srls, and to the extent permitted by applicable law, you retain your rights in the Input and we assign to you any rights we may have in the comic output generated specifically for your request. You may use that output for lawful personal or commercial purposes, provided you have the necessary rights in all people, brands, characters, locations and other material depicted.
AI output may not qualify for copyright or exclusive protection in every country. It may be similar to output generated for someone else and may inadvertently contain elements resembling third-party works, marks or styles. We do not guarantee uniqueness, non-infringement, registrability, commercial suitability or exclusive rights. You are responsible for review and, where appropriate, professional clearance before commercial publication.
ComiGami’s software, interface, branding, prompts, style definitions, catalog, website content and other service materials remain protected by the rights of Chebellagiornata Srls and its licensors. These Terms do not permit you to copy or redistribute the Service itself.
12. Prohibited content and use
You must not use the Service to:
- upload or reproduce a person’s likeness without express permission and all necessary rights, or create content intended to confuse others about whether a real person performed, said or endorsed something;
- identify a person from an image, create or contribute to a facial-recognition database, perform remote biometric identification, infer sensitive traits, or profile a person from facial or biometric information;
- create non-consensual intimate imagery, sexual violence, harassment, threats, stalking, bullying, defamation, hateful abuse, fraudulent impersonation or deceptive evidence of a real event;
- exploit, endanger, sexualize or otherwise harm a person under 18, create or upload child sexual abuse material, or expose a minor to age-inappropriate sexual, graphic violent or self-harm content;
- infringe intellectual-property, privacy, publicity, confidentiality or other rights, or submit content you are not entitled to use;
- facilitate illegal activity, terrorism, violent wrongdoing, weapons development, malicious cyber activity, fraud or other harmful conduct;
- bypass payment, free-use, credit, safety, authentication, rate or access controls; exploit reinstallations or multiple identities to claim duplicate benefits; or manipulate refund and purchase systems;
- use bots, scripts, scraping, bulk automation or unauthorized interfaces to generate at scale, disrupt the Service, probe security, access another user’s jobs or data, or exhaust provider resources;
- reverse engineer, decompile, extract models, prompts or source code, or copy and redistribute the App, except where applicable law or an open-source licence expressly permits it.
This list is not exhaustive. Use must also comply with applicable law, Apple’s rules and the safety requirements of our AI provider. We may automatically moderate, reject, remove or restrict content or access where reasonably necessary. A confirmed rejected request is handled under the credit rules for confirmed failures; an uncertain provider outcome may remain pending until reconciled.
To report content or an intellectual-property concern, email info@chebellagiornata.com with sufficient details to identify the issue, without sending unnecessary personal information.
13. Local library, deletion and sharing
Characters, environments, drafts and saved comic pages are primarily stored on your iPhone. You can edit or delete materials and delete saved comics using the available App controls. Deleting a local item does not reverse a completed generation or return credits.
A generated result may remain temporarily recoverable on our server for the period described in the Privacy Policy, but this is not permanent storage. After that period, we may be unable to recover a local comic that was deleted, lost or never downloaded. Keep an export or device backup of anything important.
Saved comics remain viewable in local History without an active subscription. Sharing or saving to Photos is initiated by you. Once you send content to another person, social network, cloud drive or other service, that recipient’s terms and privacy practices apply.
14. App licence and Apple’s role
The App is licensed, not sold. Its App Store software licence is governed by Apple’s Standard Licensed Application End User Licence Agreement, unless a custom licence is expressly presented through the App Store. These Terms supplement that licence for ComiGami’s generation, credit, purchase, storage and support services.
Chebellagiornata Srls, not Apple, is responsible for ComiGami and its support, subject to Apple’s obligations under its own terms. Apple is responsible for its account, store, payment, subscription, refund and platform services. Nothing in these Terms expands Apple’s obligations or reduces mandatory consumer rights.
15. Availability, models and changes to the Service
We provide the Service with reasonable care and skill. Maintenance, security incidents, internet failures, capacity constraints or interruptions at Apple, RevenueCat, Firebase, Railway, OpenAI or other providers may temporarily affect availability. We do not guarantee uninterrupted service, a fixed generation time or identical output from changing AI models.
We may update models, prompts, styles, interface, compatibility requirements and technical limits for security, legal compliance, quality, cost control, error correction or improvement. We will not use this clause to remove mandatory rights or materially reduce an already purchased offering without the notice, consent and remedies required by law and the App Store.
If we discontinue the Service or a paid feature, we will provide reasonable advance notice where possible and any remedy required by law, including an appropriate route for affected unused purchased credits. Urgent security, legal or provider measures may require earlier action.
16. Suspension and termination
You may stop using the Service at any time. You may delete local content and request deletion of eligible server-side information as described in the Privacy Policy. Remember that data deletion does not cancel an Apple subscription.
We may restrict or suspend generations where reasonably necessary because of a material breach, unlawful or harmful content, fraud, payment reversal, attempted duplicate benefits, serious security risk, provider policy enforcement or legal requirement. Where appropriate, we will give notice and an opportunity to resolve the issue. Urgent restrictions may apply without prior notice, but you may contact us for review.
A restriction does not automatically remove a refund or other remedy required by law. Provisions that need to survive termination, including payment reconciliation, intellectual property, privacy, liability and dispute terms, continue only to the necessary extent.
17. European consumer rights
EU consumers generally have a statutory right to withdraw from a distance service contract within 14 days, subject to applicable conditions and exceptions. Immediate performance of digital content or services can affect that right only where the legally required information, express request, consent and acknowledgement have been obtained. These Terms do not themselves waive a withdrawal right.
For an App Store transaction, use Apple’s applicable withdrawal or refund process and the information supplied with the purchase. You may also notify us at info@chebellagiornata.com where the right applies to our contract. We will assist or direct the request appropriately without restricting statutory rights.
You retain mandatory rights relating to the supply and conformity of digital content and services, including applicable rights to correction, continued conformity during a subscription, price reduction, termination and reimbursement. The creative and probabilistic nature of AI does not remove those rights or our obligation to supply the features we actually promise.
Optional withdrawal notice
You may use the following wording; use of this form is not mandatory:
To: Chebellagiornata Srls, Via San Crispino 106, 35129 Padova, Italy; info@chebellagiornata.com.
I hereby give notice that I withdraw from my contract for the following ComiGami service or purchase:

Order date:
Apple order reference, if available:
Consumer name:

18. Responsibility and liability
The limitations described in Section 3 explain the nature of AI generation. They do not exclude our obligation to provide the Service and paid features with the care, functionality and conformity required by law.
To the extent permitted by law, we are not responsible for losses caused by unlawful or unauthorized Input, your decision to publish an unreviewed output, loss of local-only content following device loss or deletion, unsupported modifications to your device, or use of the Service outside these Terms. We are not responsible for business losses where you use a consumer Service for a commercial purpose beyond what could reasonably have been foreseen when the contract was made.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury where liability cannot lawfully be limited, breach of mandatory data-protection duties, or any other liability or consumer remedy that the law does not allow us to exclude.
19. Governing law and disputes
These Terms are governed by Italian law, without depriving consumers of mandatory protections available under the law of their country of habitual residence.
Contact us first at info@chebellagiornata.com so we can try to resolve a concern. This does not prevent you from bringing a claim, contacting an authority or using any dispute-resolution route available under applicable law.
Disputes may be brought before the courts competent under applicable law. EU consumers retain the consumer-jurisdiction rights available to them. These Terms do not impose mandatory arbitration or a class-action waiver.
20. Third-party components and acknowledgements
The App may include fonts, icons, open-source libraries and other components licensed by third parties. Those components remain subject to their respective licences. Applicable notices and acknowledgements are made available in the App, accompanying documentation or on request. No third-party name or mark implies endorsement of ComiGami.
21. Changes to these Terms
We may update these Terms for legal, security, technical or product reasons. The current version and date will be published here. We will give appropriate advance notice of material changes and request renewed acceptance where required.
Changes do not retroactively alter completed purchases, make separately purchased credits expire, or silently convert an active legacy entitlement. Where applicable law gives you a right to reject a material change, end the contract or obtain a remedy, we will respect that right.
If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Failure to enforce a provision on one occasion does not waive our right to enforce it later.
